Xie Lian was out because of the adventure he went on, they didn't get back until after the murders happened. Tsuru is a swordsman and would've killed them quickly and on land, not all of this. He's very...honorable, I guess? He wouldn't set up a trap like that to murder. Nero was injured and would not have been able to do everything on the water without severely hurting himself too.
